These Terms of Use ("Terms") govern your access to and use of the GearWise iOS application and website (collectively, the "Service") provided by GearWise ("we", "us", or "our"). By downloading, installing, or using GearWise, you agree to be bound by these Terms. If you do not agree, do not use the Service.
You must be at least 13 years old to use GearWise. By using the app, you represent that you meet this requirement. If you are under 18, you represent that a parent or guardian has reviewed and agreed to these Terms on your behalf.
We grant you a limited, non-exclusive, non-transferable, revocable license to use GearWise for your personal, non-commercial use, subject to these Terms. You may not copy, modify, distribute, sell, or lease any part of the Service, nor may you reverse engineer or attempt to extract the source code.
GearWise offers optional premium features through in-app purchases and auto-renewing subscriptions available on the Apple App Store.
Subscription management and cancellation is handled through your Apple ID account settings, not through the GearWise app directly.

Outdoor activities including hiking and climbing carry inherent risks including injury or death. GearWise does not guarantee the accuracy, completeness, or timeliness of any trail conditions, weather data, gear recommendations, or route information provided through the app. You assume full responsibility for decisions made based on information from GearWise. All content within GearWise — including but not limited to the name, logo, design, text, graphics, and software — is owned by or licensed to us and is protected by applicable intellectual property laws. Nothing in these Terms grants you any right to use our trademarks, logos, or brand features without our prior written consent.
You agree not to use GearWise to:
GearWise is provided "as is" and "as available" without warranties of any kind, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or free of harmful components.
To the fullest extent permitted by law, GearWise and its owners, employees, and affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages — including loss of data, personal injury, or death — arising out of or related to your use of the Service or any outdoor activity undertaken in connection with it, even if we have been advised of the possibility of such damages.
Our total liability to you for any claim arising from these Terms or the Service shall not exceed the amount you paid us in the 12 months preceding the claim, or $10 USD, whichever is greater.
You agree to indemnify, defend, and hold harmless GearWise and its owners from and against any claims, damages, losses, liabilities, costs, and expenses (including reasonable legal fees) arising out of your use of the Service or your violation of these Terms.
The Service may contain links to or integrate with third-party services (including Apple's App Store and AI providers). These third parties have their own terms and privacy policies, which you are subject to when using their services. We are not responsible for third-party content, practices, or policies.
We may suspend or terminate your access to GearWise at any time, with or without cause, and without prior notice. Upon termination, your license to use the Service ends immediately. Provisions that by their nature should survive termination — including disclaimers, limitations of liability, and indemnification — will continue to apply.
We may update these Terms from time to time. We will update the "Last updated" date at the top. Continued use of GearWise after changes constitutes acceptance of the revised Terms. If the changes are material, we will make reasonable efforts to notify you through the app or App Store update notes.
These Terms are governed by and construed in accordance with applicable law. Any disputes arising under these Terms shall be resolved through binding arbitration or in a court of competent jurisdiction, as applicable in your jurisdiction.
